I.General provisions

The Online Ticket Sales System is run by ZATORLAND Sp z o.o. z siedzibą w Zatorze, adres: ul. Parkowa 7, 32-640 Zator, NIP: 551 22 52 345, the place of business and the address for services:  Parkowa Str. 7, 32-640 Zator, the e-mail address: info@zatorland.pl, tel. 0048 667 979 220.
These Regulations are applicable to the Online Ticket Sales System and they determine the type and extent of the services rendered online via the Online Ticket Sales System as well as the ruls of rendering these services, terms of making sales deals and theier cancellation, and the complaint procedure.
Every customer intending to make use of the Online Ticket Sales System is obliged to observe the provisions of these Regulations. It is obligatory for customers to learn these Regulations and to accept them in order to place an order for tickets via the Online Ticket Sales System. The Online Ticket Sales System renders retail sales of tickets that enable visiting and using attractions provided within presented offers. 
In all matters not covered by these Regulations, the provisions of the Act of Rendering Electronic Services from 18 July 2002 (Journal of Laws No. 144, pos. 1204, as amended),  the Consumer Right Act from 30 May 2014 r. (Journal of Laws No. 2014 pos. 827), the Civil Code from 23 April 1964 (Journal of Laws No. 16, pos. 93, as amended) and other appropriate provisions of Polish law are applicable. 

II. Definitions

WORKING DAY – one day from Monday to Friday excluding public holidays.
ORDER FORM – form available on website that enables placing orders.
CONSUMER – natural person, who performs legal action with the enterpreneur not directly related to his economic or professional activity.
CUSTOMER – client who intends to make or has made a Sales Deal with the Seller.
REGULATIONS  – these Regulations of the Online Ticket Sales System.
ONLINE TICKET SALES SYSTEM – Online Ticket Sales System of the Service Provider enabling placing orders.
SELLER, SERVICE PROVIDER – ZATORLAND Sp z o.o. z siedzibą w Zatorze, adres: ul. Parkowa 7, 32-640 Zator, NIP: 551 22 52 345.
FACILITY – facility rendering entertainment and recreational services upon tickets purchased via the Online Ticket Sales System.
TICKET  –  confirmation of a deal made by the Seller and the Customer sent online and enabling collection of the wrist band, i.e. the proper entrance ticket from the wrist band machine located at the main entrance of the Facility. The writs band enables the Customer to enterance and making use of the services rendered by the Facility to the extent corresponding with the fee paid by the Customer.
DEAL – a deal on the sales of tickets made by the Seller and the Customer via the Online Ticket Sales System.
SERVICE RECIPIENT – natural person, legal person or business unit without legal personality which gains legal capacity upon law and makes use of  an e-service.
E-SERVICE  – service rendered online by the Service Provider in favour of the Service Recipient via the Online Ticket Sales System.
ORDER – Customer’s decalration of intent constituting an offer of making a Ticket Sales Deal with the Seller. 

III. Privacy policy

ZATORLAND Sp. z o.o. cares in particular for processing and protection of the Customer’s personal data as well as meets all requirements arising from the Regulation of the European Parliament and of the Council (EU) 2016/679 from 27 April  2016 on the protection of natural persons with regard to processing personal data and on the free movement of such data as well as on the repeal of the directive 95/46/WE – so called GDPR – General Data Protection Regulation. 
Providing by Customers their personal data in the Registration Form or in the Order Form is optional, however, the ticket purchase or its reservation online will not be possible without it (applies to data marked as obligatory). Description of the data protection and the Customer’s right are contained in the Service Provider’s  Privacy Policy.

IV. Type and extent of e-services

The Service Provider enables making Ticket Sales Deals via the Online Ticket Sales System. Rendering of the e-service in favour of the Service Recipient via the Online Ticket Sales System follows the rules determined in these Regulations. The Service Provider has a right to post advertisement content in the  Online Ticket Sales System. The advertisement content in question forms integral part of the Online Ticket Sales System and of the materials posted in it. 

V. Terms of rendering services and conluding e-service contracts

Rendering of the e-service indicated in chapter III point 1 of these Regulations is free of charge.  The Deal on E-services which consists in placing orders via the Online Ticket Sales System is made for an idefinite period and is terminated at the moment of placing an order or ceasing it by the Service Recipient. 
The technical requirements which are necessary for co-operation with the computer system used by the Service Provider: a computer with the Internet access, e-mail access, Web browser or a smartphone with the Internet access.
The Service Recipient is obliged to use the Online Ticket Sales System in a manner consistent with the law and morality, and with respect for personal interests and copyright of third parties. The Service Recipient is obliged to enter the factually correct data. The Service Recipient is prohibited to provide illegal content. 

VI. Terms of making a sales deal

Information presesnted in the Online Ticket Sales System does not constitute an offer in the meaning of the law.  At the moment of placing an order, the Customer makes an offer of purchase of the specific ticket on terms indicated in its description. 
The ticket prices presented in the Online Ticket Sales System are depicted in Polish zloty (PLN) and include all components, also the VAT tax. 
The ticket prices presented in the Online Ticket Sales System are binding at the time of placing the order by the Customer. These prices will not be altered regardless of the price alternation in the Online Ticket Sales System after placing an order by the Customer, which can be made in respect of individual Products.
Making of a Sales Deal:
Placing an order by the Customer by use of the methodes provided by the Seller is necessary for making a Sales Deal.
After placing the order, the Seller will promptly confirm its receipt which is binding for the Customer.  The order confirmation will be sent via e-mail. After receiving the e-mail mentioned in the previous sentence by the Customer, the Sales Deal between the Customer and the Seller is considered made. 

VII. Terms of ticket sales

The customer chooses the kind of ticket. Optionally, the Customer may choose additional products within the offer, if such possibility is provided for. Indication of a specific date of taking use of the services is not necessary.
The Customer makes appropriate choices, verifies the order status and confirms the correctness of the data provided. Then the order execution should take place. After entering and proving of all data, the payment by use of the Przelewy24 System should be made. The payment is processed in accordance with the Regulations of the payment operator of the Przelewy24 System. The payment is settled from the Customer’s bank account. The purchase of the ticket is processed immediately. The purchased tickets are delivered to the Customer via e-mail in a pdf. file ready to print. The Customer shall print the purchased ticket or scan the bar code placed in it directly from a smartphone screen at the wrist band machine located at the main entrance to the Facility. Once the ticket has been scanned, the wrist band machine will provide the Customer with the wrist band, i.e. the proper entrance ticket. At this moment the online ticket becomes invalid. A single wrist band entitles to taking use of the services by only one person. The online ticket shall not be photocopied, scanned or copied in any other way. Shall such a pratice be detected, the ticket will be invalidated and the Customer would not be able to claim for a refund for such a ticket. Any damage to a printed ticket may cause unability of verification of the bar code and as a result unability of entering the Facility. The online tickets are vaild within the 1 season, duration of which is indicated in the park working calendar posted on the website: www.zatorland.pl Due to irregular working hours of the Facility during individual months, the Customers are requested to check the working hours of the Faciclity at the planned date of visit.

VIII. Order cancellation 

The Customer has a right to cancell the order for any reason within 14 days since the date of purchase.  Shall the online ticket be used with the consent of the Consumer before 14 days since the date of purchase, the right to order cancellation will be lost. To keep the deadline the Consumer shall send a statement of withdrawal from the Sales Deal within 14 days since the date of purchase.  The statement of withdrawal with the order number to which the withrawal applies shall be sent at the e-mail address: info@zatorland.pl  
In the event of order cancellation, the order is considered void and the Consumer is free of any obligations. The subject of the Sales Deal shall be returned unchanged and the Seller shall make a refund for the unused tickets. The refund will be made to the Consumer’s bank account from which the transfer was made.

IX. Methodes of payment

The Seller allows the following methodes of payment: bank transfer, contactless payment or credit card. Payments for the tickets can be made solely via the Przelewy24 System. The Customer does not need to be registered in the Przelewy24 System to make the payment. Once the Customer’s data has been entered and the bank selected, the Customer is forwarded to his bank’s website. In the event of payments made by use of a credit card, the Customer is forwarded to a form regarding the credit card. 

X. Cost, deadlines and delivery methodes

The purchased tickets will be delivered to the Customer in a pdf. file by e-mail (to the e-mail address entered during registration in the Online Ticket Sales System) after completing the payment procedure. 
Discounts shall not be added up.

XI. Complaint procedure

The legal basis and the Seller’s responsibility extent towards the Customer who is a Consumer are specified in the Civil Code from  23 April 1964 (Journal of Laws No. 16, pos. 93, as amended).
Notification on the product non-conformity as well as submitting a proper request may be lodged by e-mail. Where necessary for conformity assessment procedure, the notification shall be sent to: Amusement Park ZATORLAND, Parkowa Str. 7, 32-640 Zator.
The Seller shall respond to the Customer’s request immediately, not later than within 14 days. The response to the complaint will be sent to the e-mail addres given by the Customer or in any other method indicated by the Customer.
In the event of a complaint made by a Customer who is not a Consumer, the lack of handling the complaint within 14 days is unequivocal with its acceptance.
Complaints on rendering e-services via the Online Ticket Sales System can be lodged by the Service Recipient via e-mail to the address: info@zatorland.pl or can be sent by post to the address: Amusement Park ZATORLAND, Parkowa Str. 7, 32-640 Zator.
The above complaint shall include comprehensive information on the subject of complaint, in particular the type and date of the irregularities and the contact data. The information provided will make handling of the complaint by the Service Provider much easier and faster. 

XII. Privacy policy (personal data protection)

The Online Ticket Sales System has been developed to protect the Customers’ privacy and the proper technical and organizational means that provide personal data protection have been applied.  Any transmitted data is secured against disclosure to unauthorized persons as well as against its processing with violation of the applicable law.
The possibility of personal data processing results from the Customers’ consent on their own and from statutory authorisation to processing data essential for exectution of the order as well as of handling possible complaints and to faciliate future purchases.  Personal data is not processed or used for any other purpose.
The data provided by Customers of the Online Ticket Sale System is used for accounting purposes, to contct the Customer and for other avtivities related to the performance of the Deal. The current Customer’s data will be available to other entities, insofar as it is necessary for the perfomance of the Deal.
In accordance with applicable law the Customers’ data can be made available to entities entiteled to receive it, including the competent judicial authorities.
The data controller is: ZATORLAND Sp. z o.o. with the headquarters in Zator, ul. Parkowa 7, 32-640 Zator, NIP: 551 22 52 345.

XIII. Cookie files

The Online Ticket Sales System uses cookie files. No change to the browser settigns by the Service Recipient is tantamount to giving consent for their use. Installation of cookies is necessary for the proper supply of services in the Online Ticket Sales System. The cookie files contain information essential for the proper functioning of the Online Ticket Sales System, in particuar those requiring authorisation. The content of the cookies does not allow identification of the Service Reicpient. The personal data is not processed or stored by the cookie files. 

XIV. Copyright

The purchase of a ticket does not constitute the acquisition of any copyrithts or any other intellectual property rights to the products purchased by the Customer.
The tickets sold via the Online Ticket Sales System and their online sales are copyrighted. Both the Customer and the third parties are not authorized for production, distribution or reproduction of the Products. 

XV. Final provisions

The Deals made via the Online Ticket Sales System are concluded with accordance with Polish law. The Service Provider reserves the right to amend these Regulations. Any amends of these Regulations are binding for the Service Recipient provided that he was properly informed about the amends and could learn them. None of the provisions of these Regulations is intended to infringe the Service Recipient’s rights. In the event of non-compliance of any part of these Regulations with the prevailing  law, the Service Provider declares absolute submission to and application of this law in place of the challenged provision of these Regulations. ZATORLAND Sp. z o.o. is not responsible for the consequences of unauthorized duplication of the once received ticket by the Customer or third parties to whom the data of the received ticket was disclosed (including the printed or electronic copy).
Any disputes arising from the Sale Deals beetwen the parties, i.e. beetwen the Online Ticket Sales System and the Customers shell be settled in the first place by negotiation with the intention of amicable settlement of the dispute. If, however, this would not be possible or would be unsatisfactory for either party, the disputes shall be settled by a court of general jurisdiction. Any disputes between the Service Provider and the Service Recipient (the Customer) who is also a Consumer are submitted to competent courts in accordance with the provisions of the Code of Civil Procedure from 17 November 1964 (Journal of Law No. 43, pos. 296, as amended).
Any disputes beetwen the Service Provider and the Service Recipient (the Customer) who is not a Consumer are submitted to the court competent for the Service Provider’s headquarters.ZATORLAND Sp z o.o., address: Parkowa Str. 7, 32-640 Zator, NIP: 551 22 52 345.
